On September 16, 2021, RAM Law attorneys, Ed Rebenack, Tyler Hall, and Paul Brandenburg obtained an impactful win that will have significant implications for truck-crash cases around NJ. RAM Law represented the Plaintiff, a truck crash victim, who was initially barred from presenting evidence of a truck driver’s negligence. RAM Law successfully petitioned the NJ Appellate Division to create new case law favoring truck crash victims. Despite best efforts by the trucking company, the NJ Supreme Court refused to disturb RAM Law’s win in the Appellate Division.
In this case, the Defendant, the trucking company’s post-crash preventability analysis found that the truck driver acted recklessly, but the trial court excluded this evidence. The Appellate Division, in a published opinion, Hassan v. Williams, 467 N.J. Super. 190, certif. denied, ____ N.J. ___ (2021), reversed the trial court and ruled that this evidence was admissible.
