RAM Law’s Ed Rebenack settles injury lawsuit against a municipality for $725,000. The RAM Law client, a 14 year-old high school student was struck by a municipal vehicle while crossing the street in a crosswalk. The vehicle was driven by a municipal official during his workday. As a result of the crash, the RAM Law client suffered a fracture to her femur bone which required surgery. The operation implanted a metal rod and screws (intermedullary rod) to reconstruct the bone fractures. Over time, the screws started to cause pain and the client underwent additional surgeries to remove the metal rod and screws. The municipality was responsible for the negligence of the municipal official. After many years of litigation and multiple rounds of mediation, the insurance fund for the municipality agreed to pay $725,000 to settle the claims and avoid trial. RAM Law’s Howard Buckner assisted with the litigation.
