A RAM Law client suffered a significant neck injury during his use of a defective chair. The chair, which had wheels, flipped over backward while our client was attempting to back away from his work desk. Our client struck his head on the concrete floor at work and developed severe neck pain. He ultimately required surgery for his neck injury. The company that manufactured the chair is based in China with no presence in the United States. Under New Jersey’s Product Liability Act, RAM Law pursued the retailers of the chair on behalf of our client. An engineer that we retained determined that the chair, whose base was slightly narrower than the seat, did not meet industry safety standards and that there were economically feasible alternative designs which did. He also found that it was this defective design which caused the chair to be unstable and flip over under normal usage. The case settled one month before trial.
