A Hillsborough Township man was fatally struck by a car on Amwell Road on Friday. The Somerset County Prosecutor’s Office Chief of Detectives said the incident occurred near the intersection with Marshall Road.
The driver remained on the scene and has not been charged thus far. Officials have not released the identity of the pedestrian. Amwell Road was closed in both directions for police to investigate the crash, which remains under investigation by the Somerset County Prosecutor’s Office.
Under New Jersey law, drivers must yield to pedestrians at all intersections, marked and unmarked crosswalks, and when crossing major roadways during red or green traffic signals. Pedestrians also have the right of way when traffic lights turn green while they are still crossing, in marked crosswalks in the same lane, or when drivers are turning onto the same road pedestrians are crossing.
Failure to yield to pedestrians can result in a fine of up to $200, two points added to your driving record, and potential requirements to complete community service or attend driver improvement classes. Drivers who strike and kill pedestrians can face criminal charges of vehicular homicide, with sentences of up to 10 years in prison and steep fines. In some instances, drivers may also face civil liability lawsuits, including wrongful death, from the deceased’s family, which can result in significant financial damages.
