$248,500 policy limit settlement. 55 y/o client. She had prior lumbar laminectomy with spinal cord stimulator implanted mid 90’s. No MRIs due to stimulator. Aggressive smoker – 2 packs a day.

2018 crash. Defendant left-turned in front of client from bagel shop parking lot after being waved on by a ghost vehicle. CT of lumbar spine showed herniation at L3-4 and fracture of S1 pedicle screw from prior stimulator. In addition to back pain & radiculopathy, client had loss of urination control.

Lumbar fusion at L2-4 with instrumentation as well as removal of broken screw & spinal stimulator. She was also fitted with bone stimulator to assist with bone healing process.

$100k UM policy available for wave-on driver. Currently offered $20k due to liability concerns. During dep, BI driver said he would have turned into our client even if ghost driver hadn’t waved him on. We have demanded policy. Will keep you updated on progress.
