RAM Law partner, Jay Mascolo, obtained a settlement against an apartment complex for injuries sustained by his client as a result of a trip and fall accident. The RAM Law client tripped on a cracked and raised sidewalk on a common walkway while walking back to his apartment from a restaurant. He struck his head on the corner of a building and lost consciousness. The client sustained a laceration to his forehead which required 24 sutures and left a permanent scar. The client had been suffering from multiple sclerosis for 6 years prior to the accident and claimed that the traumatic head injury caused an aggravation of his pre-existing symptoms. He continued to present complaints of headaches and dizziness three years after the accident. The Defendant claimed that the client was at fault for the accident as he had a prior history of balance problems and falls and was not utilizing a cane that he had previously utilized while walking. The Defendant also contested the claim of a traumatic aggravation of multiple sclerosis. The case was assigned to Trial in Middlesex County and settled for $265,000 prior to jury selection.
