RAM Law Partner, Craig Aronow, Obtains $950,000 for Truck Driver Client Injured in Fall from Tank Trailer
A RAM Law client was injured when he fell from a tank trailer. The motor carrier that employed the truck driver failed to train him to properly depressurize the tank trailer. The delivery facility did not have fall protection equipment for him and they failed to follow their own unloading procedures by not notifying him when the tank trailer was empty of product. The facility’s personnel closed the tank trailer’s discharge valve and let the tank trailer continue to fill with air until fully pressurized. Unclear on why the tank trailer was fully pressurized and how to depressurize it, our client tried to figure out how to resolve the situation and in the process fell from the trailer ladder, injuring both of his legs.
Motor carriers, under federal law, are required to make sure that truck drivers are properly trained to handle the motor carrier’s freight. Facilities accepting loads are not permitted to create hazardous conditions.
