$212,500 Settlement for Slip and Fall in Parking Lot
RAM Law obtained a $212,500 settlement for a client who slipped and fell on ice in a parking lot that was not properly salted. The client suffered a severe fracture requiring surgery to repair the injury. Despite a lack of snow or ice fall in the days leading up to the accident, RAM Law was able to prove that a combination of fluctuating temperatures and large amounts of standing snow from previous snow storms caused the water runoff from the melting snow to travel onto the parking lot and refreeze. Through the depositions of the property owner and property manager, RAM Law established that the defendant either knew or should have known that ice would form in that area but failed to properly inspect and treat the area with an ice melt solution.
The case was filed by RAM associate Tyler Hall in the Superior Court of New Jersey in Somerset County. The case settled following a non-binding arbitration and months before trial was scheduled.
