In most personal injury lawsuits, the other side will not pay your legal fees. Fortunately, we accept most personal injury cases on a contingent fee basis. A contingency fee means that we receive a fee only if we obtain a recovery for you and our fee is based upon a percentage of the settlement or trial award. If you do not receive any compensation for damages, our firm is entitled to nothing and you pay no fee or expense. In most cases, the contingency fee is 33 1/3% of a net recovery up to the first $500,000 with a reduction in the percentage for amounts above $500,000. The contingent fee is perhaps the one device in law that gives injured people, no matter what their financial means, an even break in the courtroom against giant corporations and insurance companies.
However, there are exceptions to the rule regarding payment of personal injury attorney fees based upon the type of claim. For personal injury claims based upon sexual harassment, discrimination, employment violations, civil rights violations or violations of the New Jersey Law Against Discrimination, the other side may be compelled to pay attorneys fees and costs if you are successful.
